The following terms will set forth an agreement between Not Just A Pretty Face Photobooth(Provider) and the person(s) named in the invoice (Client) the parties, for photo booth services for an event taking place at the venue listed in the invoice. These written terms sets forth the full, written intention of both parties and supersedes all other written and/or oral agreements between the parties.

SERVICE PERIOD: The Service Period is agreed in the above invoice. Provider agrees to have the photo booth operational for a minimum of 85% of the booked service period; occasionally, operations may need to be interrupted for maintenance of the Photo Booth, but is very rare. In the event the booked photobooth design becomes unavailable, through damage or error, a booth of equal value shall be provided on the night.

PAYMENT: A non-refundable deposit/reservation fee in the amount of £40 is due upon booking. The remaining balance is due 28 days before the event. If the operator uses the equipment for a time period in excess of the service period agreed, the overage in rental time will be billed to the operator at the rates set out. Payment for any overage in time must be paid before additional hours are provided however upon agreement these can be billed to the Client at a later date.

VENUE ACCESS, SPACE & POWER FOR PHOTO BOOTH: Provider will arrive approximately 60 minutes prior to the agreed upon start time for setup. Depending on the selected booth the Provider requires a maximum of 2m (H) x 2.3m (L) x 1.3m (W) for Providers booth and room for 1 or 2 6ft prop tables. The Rustic open air booth requires the backdrop to be situated 10ft from the booth if a backdrop is requested. If a backdrop is requested, the required height needed for the backdrop is 8ft. A standard UK power socket is required for the booth to operate. Outdoor events vary and require more space. Client accepts responsibility that no refunds will be given if the photo booth cannot operate due to failure on meeting access, space and power requirements. Client also accepts that the Provider is not liable for any interruption to services due to inadequate power or weather conditions.

DATE CHANGES & CANCELLATIONS: Any request for a date change must be made in writing at least 28 days in advance of the original event date. Change is subject to photo booth availability and receipt of a new booking. If there is no availability for the alternate date, the non- refundable reservation fee shall be forfeited and event cancelled. If event is cancelled for any reason, the non-refundable reservation fee is forfeited. Should the Client cancel within 28 days of the event date, the Client is liable for the full balance.

DAMAGE TO PROVIDER’S EQUIPMENT: Client acknowledges that it shall be responsible for any damage or loss to the Provider’s Equipment caused by: A) Any misuse of the Provider’s Equipment by Client or its guests, or B) Any theft or disaster. Damages may include but are not limited to alcohol spilled on equipment, kicking or knocking over of equipment, or theft of any equipment. Provider will notify Client immediately upon discovery of an accident or loss, however this may be during or after the services have been provided.

INDEMNIFICATION: Client agrees to, and understands the following: A) Client will indemnify provider against any and all liability related to Client’s Event during or after Client’s event. Client will indemnify Provider from the time of service and on into the future, against any liability associated with Client. B) Client will indemnify Provider against any and all liability associated with the use of pictures taken by Provider, its representatives, employees or affiliates at Client’s event.

MODEL RELEASE: Client agrees to, and understands the following: All guests using the photo booth hereby give Provider the right and permission to copyright and use, photographic portraits or pictures of any photo booth user who may be included intact or in part, made through any and all media now or hereafter known for illustration, art, promotion, advertising, trade, or any other purpose. In addition I, hereby release, discharge and agree to save harmless Provider, from any liability, that may occur or be produced in the taking of said picture or in any subsequent processing thereof, as well as any publication thereof, including without limitation any claims for libel or invasion of privacy. If Client does not agree, Client must inform provider by emailing [email protected] prior to the event. Client accepts without written acknowledgement, Provider has not received the client disagreement.

SAFETY: Provider reserves the right to deny any guest access to any equipment or services owned or operated by Provider. Provider is not liable for any injuries or damages caused to the client or client guests. Provider reserves the right to cease operation of any equipment or services should they feel it necessary.

MISCELLANEOUS TERMS: If any provision of these terms shall be unlawful, void, or for any reason unenforceable under Contract Law, then that provision, or portion thereof, shall be deemed separate from the rest of this contract and shall not affect the validity and enforce-ability of any remaining provisions, or portions thereof. This is the entire agreement between Provider and Client relating to the subject matter herein and shall not be modified except in writing, signed by both parties. In the event of a conflict between parties, Client agrees to solve any arguments via arbitration. In the event Provider is unable to supply a working photo booth for at least 85% of the Service Period, Client shall be refunded a prorated amount based on the amount of service received. If no service is received, Provider’s maximum liability will be the return of all payments received from Client. Provider is not responsible for any consequential damages or lost opportunities upon breach of this agreement.
